2. Eligibility

To place an order you must be at least 18 years old and legally capable of entering into a binding contract under Egyptian law. If you are under 18, you may only use the Site under the supervision of a parent or legal guardian who accepts these Terms on your behalf.


 

 

3. Products and Intended Use

3.1 Memo Baby sells personal care and skincare products intended for babies and children, including creams and balms.


3.2 Our products are cosmetic personal care products intended for external use only. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease or medical condition.


3.3 Before first use, you should read the full ingredient list and usage instructions printed on the product packaging and, where relevant, perform a patch test. If your child has a known skin condition, allergy, or is under medical care, consult a physician or pharmacist before use.


3.4 Stop use immediately and seek medical advice if irritation, redness, rash or any adverse reaction occurs. Keep products out of reach of children and away from the eyes and mouth. Store in a cool, dry place away from direct sunlight.

4. Product Information, Images and Availability

4.1 We make reasonable efforts to describe our products accurately. However, product images, colours and packaging are for illustration only and may differ slightly from the item delivered, including as a result of your device's screen settings or a change in packaging design.


4.2 All products are subject to availability. We may add, modify, limit or discontinue any product at any time without prior notice.


4.3 We reserve the right to limit the quantity of any product sold per customer, per household or per order.


 

 

5. Prices, Offers and Taxes

5.1 All prices are displayed in Egyptian Pounds (EGP) and, unless expressly stated otherwise on the product page, are inclusive of applicable value added tax.


5.2 Shipping fees are additional and are calculated at checkout based on the delivery area, as described in our Shipping Policy.


5.3 We may change prices, promotions and discounts at any time. Price changes do not apply retroactively to orders already confirmed by us.


5.4 Promotional offers, discount codes and bundles are valid only for the stated period, cannot be combined unless expressly stated, and have no cash value.


5.5 Pricing errors. Despite our efforts, a product may occasionally be listed at an incorrect price due to a technical or human error. Where the error is obvious and could reasonably have been recognised by you as a mispricing, we are not obliged to supply the product at the incorrect price. In that case we will contact you to confirm whether you wish to proceed at the correct price or cancel the order, and if we cannot reach you, we will cancel the order and refund any amount paid in full.


 

 

6. Orders and Contract Formation

6.1 Placing an order on the Site constitutes an offer by you to purchase the products in your cart under these Terms.


6.2 An automated order confirmation email or message acknowledges receipt of your order but does not by itself constitute acceptance. The contract of sale is formed when we confirm the order and dispatch the products to you.


6.3 We may refuse, cancel or reduce any order at our discretion, including where:


  • the product is unavailable or a pricing/description error has occurred;

  • we suspect fraudulent, abusive or resale-driven activity;

  • the delivery address is outside our service area or cannot be verified;

  • the customer has a history of repeatedly refusing cash-on-delivery orders;

  • we are unable to obtain authorisation for your payment.


6.4 If we cancel a confirmed and paid order, we will refund the amounts paid for that order in full.


 

 

7. Payment

7.1 Accepted payment methods are those displayed at checkout, which may include cash on delivery and electronic payment methods.


7.2 Online payments are processed through third-party payment providers integrated with our platform. We do not store your full card details on our systems. Your use of a payment provider is also subject to that provider's own terms and privacy policy.


7.3 For cash-on-delivery orders, the full amount must be paid to the courier at the time of delivery. Repeated refusal to accept delivered orders may result in cash on delivery being disabled for your account or future orders being declined.


7.4 You confirm that any payment method you use belongs to you or that you are authorised to use it.


 

 

8. Shipping and Delivery

8.1 We deliver across the Arab Republic of Egypt. Estimated delivery is 2–5 business days, and shipping fees vary by area. A tracking number is provided once your order is shipped.


8.2 Delivery timeframes are estimates, not guarantees. Delays may occur due to courier capacity, weather, official holidays, incorrect or incomplete addresses, or circumstances outside our reasonable control.


8.3 It is your responsibility to provide a complete and accurate delivery address and a reachable phone number. Orders returned to us because of an incorrect address or repeated failure to receive the courier may incur re-shipping fees.


8.4 Risk of loss and damage passes to you upon delivery of the products to you or to the person receiving them at your address.

9. Returns and Refunds

9.1 Products may be returned within 14 days of receipt, provided they are in their original condition and unused, with intact packaging and any seals unbroken.


9.2 For hygiene and safety reasons, opened, used or unsealed skincare products cannot be returned or exchanged, except where the product is defective, damaged on arrival, expired, or is not the product you ordered.


9.3 Refunds are issued after we receive and inspect the returned product and complete the necessary procedures. Refunds are made to the original payment method or by another method agreed with you.


9.4 If you receive a damaged, defective or incorrect item, contact us within [INSERT: e.g. 48 hours] of delivery with photographs of the product and packaging so we can arrange a replacement or refund at no cost to you.

10.1 You may create an account to place and track orders. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.


10.2 You agree to provide accurate, current and complete information and to keep it updated.


10.3 We may suspend or terminate any account that we reasonably believe is being used fraudulently, abusively, or in breach of these Terms.


 

 

11. Acceptable Use

You agree not to:


  • use the Site for any unlawful, fraudulent or harmful purpose;

  • purchase products for commercial resale without our prior written consent;

  • attempt to gain unauthorised access to the Site, its servers or any connected system;

  • introduce viruses, malicious code, scrapers, bots or automated tools that interfere with the normal operation of the Site;

  • copy, scrape or reproduce Site content for commercial purposes;

  • submit false, misleading or defamatory content, or content that infringes the rights of others.


We may restrict or terminate your access to the Site for any breach of this section.


 

 

12. Reviews and User-Submitted Content

12.1 If you submit a review, comment, photo or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish and display that content in connection with our business, including in marketing materials, unless you tell us otherwise in writing.

The Site may contain links to third-party websites, social media pages or services, and relies on third-party providers for hosting, payment and delivery. We are not responsible for the content, policies or practices of third parties. Accessing them is at your own risk and subject to their own terms.


 

 

15. Disclaimers

15.1 The Site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or free of viruses or other harmful components.


15.2 Information published on the Site, including FAQs and general skincare guidance, is provided for general information only and does not constitute medical advice. It is not a substitute for consultation with a qualified physician or pharmacist.


15.3 Any statement that a product is suitable for sensitive skin reflects the product's intended formulation and does not guarantee that every individual will tolerate it, as skin sensitivity varies.


 

 

16. Limitation of Liability

16.1 To the maximum extent permitted by applicable Egyptian law, our total liability arising out of or in connection with any order shall not exceed the total amount paid by you for that order.


16.2 We are not liable for indirect, incidental or consequential loss, including loss of profit or opportunity.


16.3 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded, including a consumer's statutory rights under Egyptian consumer protection law.


 

 

17. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, strikes, civil unrest, government action, import restrictions, failures of couriers or payment providers, or interruptions to internet or power supply.

Your personal data is collected and processed in accordance with our Privacy Policy, which forms part of these Terms and describes what data we collect, how we use it, and your rights in relation to it.

٢. أهلية التعاقد

يجب ألا يقل عمرك عن ١٨ عامًا وأن تكون كامل الأهلية القانونية للتعاقد وفقًا للقانون المصري. إذا كنت دون ١٨ عامًا، فلا يجوز لك استخدام الموقع إلا تحت إشراف ولي الأمر أو الوصي القانوني الذي يقبل هذه الشروط نيابة عنك.


 

 

٣. المنتجات والاستخدام المقصود

٣.١ تبيع ميمو بيبي منتجات عناية شخصية وعناية بالبشرة مخصصة للأطفال والرضّع، وتشمل الكريمات والبلسم.


٣.٢ منتجاتنا هي منتجات تجميل وعناية للاستخدام الخارجي فقط، وليست أدوية، وغير مخصصة لتشخيص أو علاج أو الوقاية من أي مرض أو حالة طبية.


٣.٣ قبل الاستخدام الأول، يُرجى قراءة قائمة المكوّنات وتعليمات الاستخدام المدوّنة على العبوة، وإجراء اختبار موضعي على جزء صغير من الجلد عند الاقتضاء. وإذا كان طفلك يعاني من حالة جلدية أو حساسية معروفة أو يخضع لإشراف طبي، فاستشر الطبيب أو الصيدلي قبل الاستخدام.


٣.٤ أوقف الاستخدام فورًا واطلب المشورة الطبية في حال حدوث تهيّج أو احمرار أو طفح أو أي رد فعل غير معتاد. يُحفظ المنتج بعيدًا عن متناول الأطفال وبعيدًا عن العين والفم، ويُخزَّن في مكان بارد وجاف بعيدًا عن أشعة الشمس المباشرة.


٣.٥ تتوفر معلومات السلامة الإضافية في سياسة السلامة ومعلومات المنتج، وهي جزء لا يتجزأ من هذه الشروط.


 

 

٤. معلومات المنتجات والصور والتوافر

٤.١ نبذل جهدًا معقولًا لوصف منتجاتنا بدقة، إلا أن الصور والألوان وتصميم العبوة تُعرض للتوضيح فقط وقد تختلف اختلافًا بسيطًا عن المنتج المُسلَّم، بما في ذلك بسبب إعدادات شاشة جهازك أو تغيير في تصميم العبوة.


٤.٢ جميع المنتجات خاضعة للتوافر، ويجوز لنا إضافة أو تعديل أو إيقاف أي منتج في أي وقت دون إشعار مسبق.


٤.٣ يحق لنا تحديد الكمية المسموح بشرائها لكل عميل أو لكل طلب.


 

 

٥. الأسعار والعروض والضرائب

٥.١ جميع الأسعار معروضة بـ الجنيه المصري (EGP)، وهي شاملة ضريبة القيمة المضافة المطبقة ما لم يُنص صراحةً على خلاف ذلك في صفحة المنتج.


٥.٢ تُضاف رسوم الشحن بشكل منفصل وتُحتسب عند إتمام الطلب حسب منطقة التوصيل، وفقًا لسياسة الشحن.


٥.٣ يجوز لنا تعديل الأسعار والعروض والخصومات في أي وقت، ولا تسري التعديلات بأثر رجعي على الطلبات المؤكدة بالفعل.


٥.٤ العروض الترويجية وأكواد الخصم صالحة للمدة المحددة فقط، ولا يجوز الجمع بينها ما لم يُنص على ذلك، وليست لها قيمة نقدية.


٥.٥ الأخطاء السعرية. قد يظهر منتج بسعر غير صحيح نتيجة خطأ تقني أو بشري. وإذا كان الخطأ واضحًا بدرجة يمكن معها لأي شخص معقول إدراك أنه خطأ، فلا نلتزم بتوريد المنتج بذلك السعر، وسنتواصل معك لتأكيد رغبتك في الشراء بالسعر الصحيح أو إلغاء الطلب. وفي حال تعذّر الوصول إليك، سيتم إلغاء الطلب ورد أي مبلغ مدفوع بالكامل.


 

 

٦. الطلبات وانعقاد التعاقد

٦.١ يُعد إتمامك لطلب على الموقع إيجابًا منك لشراء المنتجات وفقًا لهذه الشروط.


٦.٢ رسالة تأكيد استلام الطلب التلقائية تُفيد باستلامنا للطلب فقط، ولا تُعد قبولًا بذاتها. ينعقد عقد البيع عند تأكيدنا للطلب وشحنه إليك.


٦.٣ يجوز لنا رفض أو إلغاء أو تخفيض أي طلب وفقًا لتقديرنا، ومن ذلك في الحالات التالية:


  • عدم توافر المنتج أو وجود خطأ في السعر أو الوصف؛

  • الاشتباه في نشاط احتيالي أو تعسفي أو بغرض إعادة البيع؛

  • وقوع عنوان التوصيل خارج نطاق خدمتنا أو تعذّر التحقق منه؛

  • تكرار رفض العميل استلام طلبات الدفع عند الاستلام؛

  • تعذّر الحصول على تفويض للدفع.


٦.٤ في حال إلغائنا لطلب مؤكد ومدفوع، سنقوم برد المبالغ المدفوعة عنه بالكامل.


 

 

٧. الدفع

٧.١ وسائل الدفع المقبولة هي المعروضة عند إتمام الطلب، وقد تشمل الدفع عند الاستلام ووسائل الدفع الإلكتروني.


٧.٢ تتم معالجة المدفوعات الإلكترونية عبر مزوّدي خدمات دفع خارجيين، ولا نحتفظ ببيانات بطاقتك كاملة على أنظمتنا. ويخضع استخدامك لمزوّد الدفع لشروطه وسياسة الخصوصية الخاصة به.


٧.٣ في حالة الدفع عند الاستلام، يُدفع المبلغ كاملًا لمندوب الشحن وقت التسليم. وقد يؤدي تكرار رفض استلام الطلبات إلى إيقاف خيار الدفع عند الاستلام أو رفض طلباتك المستقبلية.


٧.٤ تقر بأن وسيلة الدفع المستخدمة تخصك أو أنك مفوّض باستخدامها.


 

 

٨. الشحن والتوصيل

٨.١ نقوم بالتوصيل في جميع أنحاء جمهورية مصر العربية خلال ٢–٥ أيام عمل، وتختلف رسوم الشحن حسب المنطقة، ويتم إرسال رقم تتبع بمجرد شحن الطلب.


٨.٢ مدد التوصيل تقديرية وليست مضمونة، وقد تحدث تأخيرات بسبب شركات الشحن أو الأحوال الجوية أو العطلات الرسمية أو عدم دقة العنوان أو ظروف خارجة عن إرادتنا المعقولة.


٨.٣ تقع على عاتقك مسؤولية تقديم عنوان دقيق وكامل ورقم هاتف يمكن الوصول إليه. وقد تُفرض رسوم إعادة شحن على الطلبات التي تُرد إلينا بسبب خطأ في العنوان أو تكرار تعذّر التسليم.


٨.٤ تنتقل تبعة الهلاك والتلف إليك بمجرد تسليم المنتجات إليك أو إلى من يستلمها في عنوانك.


٨.٥ التفاصيل الكاملة موضحة في سياسة الشحن، وهي جزء من هذه الشروط.


 

 

٩. الاسترجاع والاسترداد

٩.١ يمكن استرجاع المنتجات خلال ١٤ يومًا من تاريخ الاستلام، بشرط أن تكون بحالتها الأصلية وغير مستخدمة، وبعبوة سليمة وأختام غير مفضوضة.


٩.٢ لدواعي النظافة والسلامة، لا يمكن استرجاع أو استبدال منتجات العناية بالبشرة المفتوحة أو المستخدمة أو المفضوضة الختم، إلا إذا كان المنتج معيبًا أو تالفًا عند الاستلام أو منتهي الصلاحية أو مخالفًا لما تم طلبه.


٩.٣ يتم رد المبالغ بعد استلام المنتج المرتجع وفحص حالته واستكمال الإجراءات اللازمة، ويُرد المبلغ بنفس وسيلة الدفع الأصلية أو بأي وسيلة أخرى يتم الاتفاق عليها.


٩.٤ في حال استلام منتج تالف أو معيب أو خاطئ، يُرجى التواصل معنا خلال [أدخل: مثلًا ٤٨ ساعة] من التسليم مع إرفاق صور للمنتج والعبوة، لنقوم بترتيب الاستبدال أو الاسترداد دون تكلفة عليك.


٩.٥ لا تنتقص هذه الشروط من حقوقك القانونية كمستهلك بموجب القانون المصري.

١٠. حسابات العملاء

١٠.١ يمكنك إنشاء حساب لإتمام طلباتك وتتبعها، وأنت مسؤول عن الحفاظ على سرية بيانات الدخول وعن جميع الأنشطة التي تتم عبر حسابك.


١٠.٢ تلتزم بتقديم بيانات صحيحة وكاملة ومحدَّثة.


١٠.٣ يجوز لنا إيقاف أو إنهاء أي حساب نعتقد بشكل معقول أنه يُستخدم بشكل احتيالي أو تعسفي أو بالمخالفة لهذه الشروط.


 

 

١١. الاستخدام المقبول

تلتزم بعدم:


  • استخدام الموقع لأي غرض غير قانوني أو احتيالي أو ضار؛

  • شراء المنتجات بغرض إعادة البيع التجاري دون موافقتنا الكتابية المسبقة؛

  • محاولة الوصول غير المصرح به إلى الموقع أو خوادمه أو أي نظام مرتبط به؛

  • إدخال فيروسات أو برمجيات ضارة أو أدوات آلية تعطّل التشغيل الطبيعي للموقع؛

  • نسخ أو استخراج محتوى الموقع لأغراض تجارية؛

  • نشر محتوى كاذب أو مضلل أو مسيء أو منتهك لحقوق الغير.


ويجوز لنا تقييد أو إنهاء وصولك إلى الموقع عند مخالفة هذا البند.


 

 

١٢. التقييمات والمحتوى المُرسل من المستخدمين

١٢.١ عند إرسالك لتقييم أو تعليق أو صورة، فإنك تمنحنا ترخيصًا غير حصري وغير مدفوع الأجر وعالميًا لاستخدام ذلك المحتوى ونشره وعرضه في إطار نشاطنا، بما في ذلك في المواد التسويقية، ما لم تُخطرنا كتابةً بخلاف ذلك.


١٢.٢ تقر بأن المحتوى الذي ترسله يخصك، وأنه صحيح، وأنه لا ينتهك حقوق أي طرف ثالث.


١٢.٣ يجوز لنا تعديل أو رفض نشر أو حذف أي محتوى وفقًا لتقديرنا، وخاصة المحتوى غير القانوني أو المسيء أو المضلل أو غير ذي الصلة.


 

 

١٣. الملكية الفكرية

جميع محتويات الموقع — بما في ذلك اسم وشعار ميمو بيبي وأسماء المنتجات والنصوص والصور والرسومات وتصميم العبوات وتنسيق الصفحات — مملوكة لنا أو لمرخّصينا ومحمية بموجب قوانين الملكية الفكرية المصرية والدولية. ولا يجوز نسخها أو إعادة إنتاجها أو توزيعها أو تعديلها أو استخدامها تجاريًا دون إذن كتابي مسبق منا.


 

 

١٤. الروابط والخدمات الخارجية

قد يحتوي الموقع على روابط لمواقع أو صفحات تواصل اجتماعي أو خدمات تابعة لأطراف ثالثة، كما نعتمد على مزوّدين خارجيين للاستضافة والدفع والشحن. ولسنا مسؤولين عن محتوى أو سياسات أو ممارسات هذه الأطراف، ويكون استخدامك لها على مسؤوليتك الخاصة ووفقًا لشروطها.


 

 

١٥. إخلاء المسؤولية

١٥.١ يُقدَّم الموقع "كما هو" و"حسب توافره"، ولا نضمن أن يكون خاليًا من الانقطاع أو الأخطاء أو الفيروسات.


١٥.٢ المعلومات المنشورة على الموقع، بما فيها الأسئلة الشائعة والإرشادات العامة للعناية بالبشرة، لأغراض المعلومات العامة فقط ولا تُعد استشارة طبية ولا بديلًا عن استشارة طبيب أو صيدلي مؤهل.


١٥.٣ أي إشارة إلى ملاءمة المنتج للبشرة الحساسة تعكس التركيبة المقصودة للمنتج ولا تُعد ضمانًا لتحمّل كل شخص له، إذ تختلف درجة حساسية البشرة من فرد لآخر.


 

 

١٦. حدود المسؤولية

١٦.١ إلى أقصى حد يسمح به القانون المصري المطبق، لا تتجاوز مسؤوليتنا الإجمالية الناشئة عن أي طلب قيمة المبلغ المدفوع فعليًا عن ذلك الطلب.


١٦.٢ لا نتحمل المسؤولية عن الأضرار غير المباشرة أو التبعية، بما في ذلك فوات الكسب أو ضياع الفرصة.


١٦.٣ لا يتضمن هذا البند أي استبعاد أو تحديد لمسؤوليتنا عن الوفاة أو الإصابة البدنية الناتجة عن إهمالنا، أو عن الغش، أو عن أي مسؤولية لا يجوز قانونًا استبعادها، بما في ذلك حقوق المستهلك المقررة بموجب قانون حماية المستهلك المصري.

لا نتحمل المسؤولية عن أي تأخير أو إخفاق في التنفيذ يرجع إلى أسباب خارجة عن إرادتنا المعقولة، ومنها الكوارث الطبيعية والأوبئة والإضرابات والاضطرابات المدنية والقرارات الحكومية وقيود الاستيراد وتعطل شركات الشحن أو مزوّدي الدفع أو انقطاع الإنترنت أو التيار الكهربائي.


 

 

١٨. الخصوصية

تُجمع بياناتك الشخصية وتُعالج وفقًا لـ سياسة الخصوصية الخاصة بنا، وهي جزء من هذه الشروط وتوضح البيانات التي نجمعها وكيفية استخدامها وحقوقك بشأنها.


 

 

١٩. تعديل الشروط

يجوز لنا تحديث هذه الشروط في أي وقت، وتسري النسخة المحدَّثة فور نشرها على الموقع مع تحديث تاريخ "آخر تحديث". وتخضع الطلبات للنسخة السارية وقت تقديم الطلب. ونشجعك على مراجعة هذه الصفحة دوريًا.


 

 

٢٠. القانون الواجب التطبيق والاختصاص القضائي

تخضع هذه الشروط لقوانين جمهورية مصر العربية، ويكون الاختصاص بنظر أي نزاع ينشأ عنها أو عن أي طلب للمحاكم المصرية المختصة في [أدخل المدينة، مثلًا: القاهرة]. ونشجعك على التواصل معنا أولًا لحل أي مشكلة وديًا.


 

 

٢١. أحكام عامة

٢١.١ إذا تبيّن بطلان أي بند من هذه الشروط أو عدم قابليته للتنفيذ، تظل باقي البنود سارية ونافذة بالكامل.


٢١.٢ عدم استعمالنا لأي حق بموجب هذه الشروط لا يُعد تنازلًا عنه.


٢١.٣ تشكّل هذه الشروط، مع سياسة الشحن وسياسة الاسترجاع والاسترداد وسياسة السلامة ومعلومات المنتج وسياسة الخصوصية، الاتفاق الكامل بينك وبيننا بشأن استخدامك للموقع.
